House prices in 2011

Mortgage lender Halifax has published its House Price Index for 2011. The main points are that in the final quarter of 2011 prices were 0.1% below the figure for the previous quarter. Between November and December prices dropped by 0.9%

For the year as a whole house prices dropped by 1.3% which means that the average house was worth £160,063 at the end of 2011.

Halifax believe that if the UK can avoid recession house prices should be reasonably stable in 2012. However they point out that there is uncertainty regarding the prospects for the UK economy. Harsher Consequences Needed for Distracted Drivers

Distracted driving is something that is plaguing the United States. It seems as though technology, particularly the cell phone has made it harder for drivers to focus on the road in front of them.

 

According to statistics, one in 11 automobile accident deaths is due to a driver being distracted by a cell phone. Law makers and auto insurance companies have not had a lot of success with their efforts to stop distracted drivers from being on the road.

 

The problem with drivers today is that they think that they are invincible. They think that they can drive and talk on their cell phone at the same time and that nothing bad will happen to them. T

Motorcycle Insurance

Currently, the United States has more than four million motorcycles registered to drive on public roads. Most major insurance carriers have responded to the needs of this substantial market by offering the same protections and benefits to riders as they do to drivers by providing motorcycle insurance policies. For bikers, the need for quality insurance protection is especially critical. According to the NHTSA, roughly 80 percent of motorcycle accidents result in death or injury, whereas with automobiles, the figure is only about 20 percent. The best way to combat these unsettling statistics is to ride safely, and that includes carrying adequate motorbike insurance protection.

By and large, motorcycle insurance looks nearly identical to coverage for a conventional vehicle.

New Rules For Discovery In Florida

Attorney Fees Awarded in TCPA Class Action Suit are not “Damages” nor “Costs” Payable Under the Supplementary Payment Provision of a CGL Policy.

Are attorney’s fees awarded in a class action settlement “damages” covered by a general liability policy?   Are they covered as “costs” under the “Supplementary Payments” Provision of a CGL policy?  Not according to the Eleventh Circuit in Alea London Limited v. American Home Services, Inc., 638 F.3d 768 (11th Cir. 2011). In that case, the Court of Appeals held that attorney fees awardable in a TCPA class action suit are not “damages” because of “personal and advertising injury” nor do they constitute costs payable under the Supplementary Payments provision of a CGL policy. Indeed, at the outset, the Court recognized that the ordinary and legal meaning of “costs” under Georgia law does not include attorneys’ fees.
